Chihuahua, Chih.- The State Human Rights Commission has received a total of 36 complaints against the staff of the different penitentiary centers in the state, accused of violating the rights of persons deprived of liberty.
The above was from January to August of this year, where the Inspectorate staff also carried out 410 inspections of penitentiary centres.
According to statistics, State Prison #3 in Ciudad Juárez is the one with the most complaints with thirteen; followed by #1 in Aquiles Serdán which has ten.
In addition, the Women’s Prison #1 has one, as does the State Prison #2; while the Women’s Prison #2 in Ciudad Juárez has four; the one in Hidalgo del Parral has two complaints, as does the one in Casas Grandes and the one in Cuauhtémoc one.
As for the Cersai of Juárez, there is one and the Undersecretariat of the Penitentiary System, Execution of Sentences and Judicial Measures as well.
The acts in violation are: failure to guarantee a dignified and safe stay for prisoners or detainees, failure to comply with the law, honesty, loyalty, impartiality and efficiency in the performance of their duties (extortion), jobs, positions or commissions (improper handling of property; failure to guard, protect and/or provide security to places, facilities or property in general affecting the rights of third parties; illegal use of property) and injuries.
Likewise, injuries, omission, refusal or inadequate provision of medical services, omission, refusal or inadequate custody of inmates or detainees are added: death in custody, improper provision of public service, cruel or inhuman treatment, punishments, legality, mistreatment, death in custody, medical omissions, family visits, threats, work-related issues and in matters of transfers.
The list includes the issue of unhealthiness, torture, acts or practices of violence against women, harassing a person for lascivious purposes, taking advantage of one’s hierarchical position (sexual harassment), intimidation or threats, excessive use of public force, obstructing or denying inmates or detainees family, marital or defense visits, and actions and omissions that violate the rights of people with some type of disability.
The Commission has also received complaints about impeding the exercise of the right to dignified and socially useful work, preventing the sentenced person from serving his sentence in the penitentiary closest to his home; failure to provide inadequate or deficient food; failure to provide protection to people who need it; failure to guard, monitor, protect; establish precautionary measures and/or provide security to people; failure to provide medication and allowing work to be carried out in conditions that violate human dignity.
In turn, there is performing any sexual act on a person without their consent, the violation of the principle of the best interests of the child and violations of the right of women to be free from all forms of discrimination.
The status of the complaints received by this body is as follows: five resolved, two withdrawn, one in conciliation and 28 in process.
