The court, after the jury’s guilty verdict, prevents him from leaving the country and forces him to go to court daily
Sandra M., the young woman considered guilty of killing her newborn baby in Yecla, will continue to be on the streets. The presiding magistrate, Juan del Olmo, decreed on Wednesday the provisional release for the defendant with a bail of 25,000 euros at the request of the Prosecutor’s Office, according to judicial sources. The woman has a maximum of 15 days to present the money in court and avoid going to prison.
The young woman, who was 19 years old at the time of the events, will not be able to leave Spain either. The magistrate has imposed a ban on him leaving the national territory, the withdrawal of his passport and the obligation to appear in court every day and to be reachable for the court.
After the guilty verdict issued by the jury, the judge must issue a resolution specifying the sentence to be imposed. The Prosecutor’s Office claims 18 years and one month in prison for the murder that the jury considered proven. The popular court, however, opened the door for the young woman to be granted a pardon by agreeing –by a majority of six to three– the request to the State for this measure of grace.
In the first hearing session, the young woman defended her innocence and maintained that she never knew she was pregnant until the moment she gave birth. “I was aware that she was giving birth when I saw the baby’s head, and I froze,” she explained. Sandra assured that she sat next to the baby “and my voice did not come out”, and so she was unable to move for a while. “I had her next to her not breathing and I put a towel on top of her.”
That argument, however, did not convince the popular court, which ruled out -by a majority of 8 to 1- that she was suffering from a pregnancy denial syndrome, as the defense maintained. The jury also understood that the young woman gave birth to a healthy baby, without malformations, who breathed autonomously – a key detail to differentiate the crime of abortion from murder. They also estimated that Sandra placed the baby’s body on a towel that completely covered her and that she did not assist the girl or ask for help for her, aware that she would not survive.
