The Commission of the Government Chamber of the Superior Court of Justice of the Valencian Community (TSJCV), meeting urgently this Wednesday afternoon, has unanimously agreed to submit to the General Council of the Judiciary (CGPJ) a proposal for the suspension of the procedural deadlines in the judicial bodies of the province of Valencia with effect from October 30 and 31, 2024.
The Government Chamber has made this decision in view of the “circumstances that are occurring due to the meteorological situation” caused by Dana, as well as after evaluating the latest information received and those that have been transferred the professional associations of lawyers, attorneys and social graduates.
The proposal has been agreed without prejudice to the suspensions of hearings, statements and other procedural actions that have been adopted in the different judicial districts, in order to “safeguard the safety of people and the provision of public service”, all of this in the framework of the Protocol for Judicial Action in Emergency Cases.
The agreement proposal that is now being urgently submitted to the CGPJ In relation to the judicial bodies based in the province of Valencia, it establishes three specific points with the following literal wording:
1-All notifications and communications sent by judicial bodies during October 30 and 31, through the Lexnet service, must be understood as notified on Monday, November 4
2-As for the calculation of procedural deadlines, October 30 and 31 will be excluded
3- In the event that force majeure persists beyond November 3, the agreement by this Chamber that the circumstances require would be adopted.
