The Supreme Court has rejected the procedure two complaints for crimes of revelation of secrets and infidelity in the custody of documents against the Minister of Finance, Maria Jesus Monteroconsidering that it did not reveal “any personal or reserved data” about Alberto González Amador, Isabel Díaz Ayuso’s boyfriend.
The Criminal Chamber has decided not to admit the complaints registered by the Liberum Association and the Foro Libertad y Alternativa Foundation for the statements in which Montero, on March 12, demanded explanations from the president of the Community of Madrid about whether ” “He is living in an apartment that was paid with fraud to the public treasury and that was paid with commissions regarding masks in the worst pandemic situation that this country had.”
These associations considered that these statements implied that Montero accessed without authorization and took possession of personal and confidential data referring to the couple. Isabel Diaz Ayuso that they were in public files or registries or that someone who accessed them without authorization provided them; that used said data publicly for political purposes and with knowledge of its illicit origin; and that the access occurred taking advantage of her position as Minister of Finance.

Which, in his opinion, “shows that, when the defendant made the statements referred to in the complaints, the Prosecutor’s complaint and its content, which included the report of the Tax Agencyhad already transcended to third parties and had been made public.
In this way “the crime of discovery and disclosure of secrets cannot be considered committed” because “no personal and confidential data was revealed about Mr. Gonzalez Amador“, but “she limited herself to giving her opinion on what, in her opinion, the President of the Community of Madrid should do in light of the news disseminated in relation to her partner.”
Furthermore, he continues, “it does not appear, from the content of his statements, that the statements made referred to data or information of which he had knowledge due to his position.”
