“I had the illusion of making me a house and I have been left with nothing. I have shattered my life.” Whoever speaks is one of those affected by the alleged scam by the owner of a company that promised them the construction of their respective homes and finally left only the foundations raised. Now, a court in Mallorca investigates the facts. The injured, more than twenty, were mortgaged to pay sums that, they say, could exceed one million euros in total. “The pain of people who have run out of money and without home is huge, also going through very hard psychological situations and seeing how he continues to unpunished,” recriminates Rafael R., who paid in advance more than 60,000 euros for a future home that has never come to see the light.
He modus operandi With which he would have acted now he was practically the same in all cases, as reported to Eldiario.es Rafael and another of those affected: after hiring the services of the company, Design Modular Haus SL, and making the first payments, the construction company began to demand new fertilizers SW pretext of the increase in materials following the pandemic and under the warning that, otherwise, the work could not begin. After accessing his demands, months later, the owner of the mercantile, Juan R., ilocalizable despite the multiple attempts to contact him, left the work completely paralyzed, taking with him, in addition, the belongings destined for some of the works and belonging to those affected. This media has tried to contact the builder, but until the moment of publication of this article has not offered its version of the facts.
“It is a potential scammer,” says Rafael, who explains that, where appropriate, he received from his parents a farm on the outskirts of the municipality of Muro, where he decided to build his first home. After obtaining the work permits, in April 2021 he contacted the constructor investigated to commission the building of the property by modular system: it was a single -family house with a pool in which, says the affected one, he had deposited all his illusions. According to the story of his complaint, he filed against the builder and his wife for alleged crimes of aggravated fraud and punishable insolvency and admitted to process in an Inca court, the owner of the company began “an incessant pressure” with the objective of closing as soon as the contract of the work alleging that there was an alleged increase in the cost of the construction materials.
Extra invoices, delays and paralyzes
“He told me that if I bought from the placement of the first stone to the delivery of the keys I could make me a more affordable price that was not so much: 291,000 euros,” continues Rafael, who states that, in the successive meetings they held to talk about the matter, the builder appeared with high -end cars alleging great solvency. Finally, the injured party accepted the conditions of the businessman and, then, proceeded to pay 10% of the work: 29,189 euros. To be able to face the payments, he made a mortgage loan for 190,000 euros that could be available as the construction work was executed.
Shortly after, he remembers, the woman of the complaint sent her by email an invoice of 16,830 euros for an alleged concept of 50% paving – without any work certification -, a cost that, says the affected, was not discounted from the initial amount paid to the builder. An invoice to which several more followed without the consequent certifications, while the works began to suffer delays and paralyzes that the denounced, according to Rafael, blamed that half of the template had been infected with Covid Oa that were on vacation.

After sending them a bureaux, nothing was heard again, beyond verifying that “they had rented through a company truck with the belongings of the work, a license poster included, without any notice”, which in their opinion would demonstrate that the will to breach with the initial contract was “definitive and irreversible.”
“Cruise in the Caribbean”
The complainant ensures that the definitive paralysis of the works also agreed with the news that the couple was “cruise in the Caribbean” and that there were numerous affected more than, like him, they did not hesitate to qualify them as “scammers” as well as the company that both used “as an instrument.” Rafael R. recriminates that the builder, which two years ago launched another company also dedicated to the promotion, construction and sale, continues to “luxury” while those affected are “destroyed”. “He wants to knead fortune at the expense of the health of others,” he laments.

A technical report issued by the work architect indicates that the cost of the built is at 13,193 euros, compared to the more than 60,000 that Rafael paid. “Almost being clear that I will not be able to recover the money, all I want is to prevent other people from falling into the scam and suffering we continue to go through,” he emphasizes.
Catalina S. is another of the people harmed by the alleged scam of Design Modular Haus SL, whose investigation was advanced by Diario de Mallorca. Speaking to this medium, the woman points out that she was one of the first who saw her claims to see her house built fell into a broken sack. In his case, the events occurred between 2017 and 2018, when he projected his home in Pòrtol: the woman had made her own design of the property and her architect had already prepared the project when she began to look for a construction company that could make it come true. Then he met Juan R.
“At the beginning very well. He gave us the budget –318,000 euros – and, when the works were already underway, he began to ask for more money in advance,” recalls Catalina, who had requested mortgage for more than 80% and had presented the certificates of the progress of the works. As he says, the entrepreneur left the works with the half -building house and after having charged extra games for which he had not even commissioned materials: he was lifted only the structure, in the, among other elements, there were no bathrooms, windows or doors. The affected regrets that he disbursed 284,000 euros to finally have no finished home.
United to demonstrate that “he acted with fraud”
“He – Juan R. – has three civil sentences lost by similar events. It alleges bankruptcy, but then create other companies,” he says. While several of the demands filed against the builder have prospered, it has not been so in the criminal jurisdiction by not having received the judges bad faith in their action.
Now, the injured have joined to try to demonstrate that he “acted with fraud” and that he proposed a contract to each of them “despite knowing that he could not execute it and thus be able to divert the money to their own benefit.” Rafael R., in his complaint, emphasizes that, as he has been able to verify after what happened, the denounced were already in a situation of generalized insolvency prior to the hiring of the construction work, “with mass breaches, so it is obvious that they wanted to, nor could they comply with the obligations assumed in the work contract”.
In 2022, the denounced launched a new society with a name similar to that with which they allegedly scammed those affected, modular Haus Mallorca, whose unique administrator is Juan R. The complainants argue that the constitution of this new society “is not a coincidence” and fear that it will be used “to distract funds or hinder the actions of the disappointed and harmed”.
