The PSOE tries to strain a reform in favor of the ‘Okupation’ in an anti -Franco law

The amendment of the PNV was approved at the time with the support of PP, ERC, Junts, Bildu, UPN and Canarian coalition. Vox abstained in that vote because he wanted to go “beyond”, but sources of the right -wing party transferred to ABC that they were going to oppose any counter -reform that the left raised in that sense, which, in principle, closes the door for a majority to reverse the current situation. From ERC and, especially, from Bildu, who apologized to his electorate, did not hesitate to show his shock and promise to do everything possible to correct his “unfortunate error.”

And that moment has now arrived, in the reform of the right of association, and with the collusion of the PSOE. Socialists defend a law proposition to illegalize the associations that make the apology of Franco. An initiative that aims to cut the passage to the Francisco Franco Foundation in application of the Democratic Memory Law to prevent it from reforming its statutes and becoming an association to avoid its illegalization: one of Pedro Sánchez’s promises in his battle against dictator Francisco Franco, who died in his bed in 1975.

Transactional amendment

Now, the year in which the Government celebrates the Forest for the fifteenth anniversary of his death, the PSOE wants to definitively approve his ‘ad hoc’ law against the Franco Foundation. But that does not prevent him from trying to introduce into it a legal change that does not keep any relationship with the norm and that seeks to satisfy the allies to their left. In the presentation that the initiative debates, the Socialists have used as a base an amendment of Podemos to transaction this modification, which remaits in favor of the illegal occupation and against what determined the Plenary of Congress in November, just a few months ago.

They sign the transactional amendment, to which ABC, the PSOE, add, ERC, Bildu and Podemos. According to parliamentary sources, the socialists have already made a first threat of introducing it in the presentation phase, but when refusing to it the PP, Vox and PNV, with a majority in the Constitutional Commission, where the law is discussed, they gave up, although they announced that they kept it alive. To Vox’s complaint, the lawyer Carlos Gutiérrez, attached to the Commission, warned of the lack of connection between the modification and the norm. This Tuesday, at half past eleven in the morning, the Constitutional Commission of the lower house meets with the objective of issuing the opinion of the initiative and raising it in full, for approval and shipping to the Senate. The expected thing is that the government parties and its allies preserve the transactional proposal, but that the PP, Vox, Juns and PNV close the door.

It can be able to attention, again, that the transaction change is carried out on the basis of an amendment, of Podemos, whose writing does not resemble the new text. Normally, the parties transaction amendments that keep connection to achieve an understanding between them and add their different proposals. Now, the result is the suppression of the letters I and Jota of section 1 of article 795 of the LECrim. That is, to eliminate the crimes of resident of article 202 of the Criminal Code and those of usurpation of article 245 of the Criminal Code, respectively, of those included in the rapid prosecution procedures.

The original amendment of Podemos, the number 8 of those registered to the reform of the right of association, basically intended to add the word “fascism” to a proposition of law that only spoke of “Francoism.” Thus, the formation of Ione Belarra proposed this wording: «Regardless of the social purposes and activities collected in the Statutes, and its registration, it will be the cause of dissolution of the associations, through judicial resolution, the realization of activities that constitute apology of the Francoism or fascism, either exalting the coup d’etat of 1936 or the posterior dictators Dignity of the victims of the coup d’etat of 1936, of the War of Spain or Franco or fascism, or direct or indirect incitement to hatred or violence against them for their condition as such ».

The ‘antiokupa’ change

In other words, the PSOE and its allies try to correct the ‘Antiokupa’ amendment that introduced the PNV in the justice efficiency law with an amendment transacted in the socialist norm that aims to eliminate the roads of existence to the Francisco Franco Foundation. The change registered by Podemos initially kept a clear connection with the initiative that is discussed now, but the one agreed by PSOE, Sumar, ERC, Bildu and Podemos himself, on the contrary, has nothing to do at all.
