Spanish justice wants to stop the feet of Fernando Presencia, a former judge expelled from the race and convicted twice for prevarication. The Public Prosecutor’s Office of the National High Court has filed a complaint this Thursday against him for crimes of libel and against the high institutions of the State for publishing alleged information in which he attributes possessions in paradise to the magistrates of the Supreme Court and the State Attorney General, Dolores Delgado. taxes and the collection of bribes.
The public ministry adopts this initiative after the president of the Criminal Chamber of the high court, Manuel Marchena, sent a letter last week to the president of the General Council of the Judiciary (CGPJ), Carlos Lesmes, where he recounted how Presencia dedicated to publishing a series of “radically false, slanderous accusations, unrelated to the truth of our financial situation.” The former magistrate, who was senior judge of Talavera de la Reina (Toledo), uses for his purposes the website of Acodap (Association against Corruption and in Defense of Public Action), which he heads, where he spreads headlines that he later replicates on networks social.
This same Thursday, the website spread a text that reads as follows: “Scandal in the Supreme Court! Caught with accounts in tax havens 9 of the 16 magistrates of its Criminal Chamber “. “Irreversible damage is being caused to the credibility of the Supreme Court. It suffers, not only the personal image of those affected, but the constitutional presuppositions that legitimize the exercise of the jurisdictional function. We believe that not only the honorability of some magistrates is at stake,” Marchena explained to Lesmes, who forwarded the documentation to the Prosecutor’s Office.
Other Supreme Court magistrates who have denounced the events have joined the words of the president of the Criminal Chamber, such as Julián Sánchez Melgar, Carmen Lamela, Vicente Magro, Pablo Llanera, Ángel Luis Hurtado, Susana Polo and Andrés Martínez Arrieta. The Prosecutor’s Office highlights that Presencia, which continues to present itself as a judge and speaks of the existence of a “criminal plot in the State Attorney General’s Office and in the Supreme Court in which the aforementioned magistrates constitute an essential piece”, always accompanies its publications of a bank account number, Paypal or Bizum so that they donate money for their supposed work in the fight against corruption.
“Everything indicates that Presencia may be obtaining economic contributions from unsuspecting citizens who believe that the donation they offer is going to be used to search for information or evidence that demonstrates the [supuesta] corruption of the magistrates of this Chamber”, denounced Marchena, who added: “[Se han detectado] attempts to modify the Wikipedia page of some of those affected with the aim of including a specific mention of these alleged acts of corruption. In its complaint, the Public Prosecutor’s Office has requested the National Court, in addition to questioning the former judge as a defendant, to close the Acodap website.
