The Prosecutor’s Office compares those accused of Samuel’s crime to a “pack of wolves”: “All against one”

The prosecutor in the trial for the murder of Samuel Luiz has compared the five accused of his death to a “pack of wolves.” He described what happened as a “group attack” and “inhumane” with the “active participation” of “everyone.” He defined the young man who admitted that he started the attack, Diego MM, as an “alpha male” and whom he recognized as grabbing the victim by the neck from behind, Alejandro FG, as “lieutenant of the leader.”

“A three-minute attack lasting 150 meters,” he summarized and insisted that there was “intention to kill,” Europa Press reports. “They were aware that with the action they were carrying out there was a high probability that he would die,” he concluded in the presentation of his final report before the Jury Court, in which he referred to the injuries accumulated on the victim’s head and the bleeding they caused.

“Everyone,” he stressed, participated in a “surprise attack” and “no defense option” for the victim. He ruled out, in this way, that what happened could be considered a fight: “We are talking about at least seven people against one.”

On the day, the penultimate before the magistrate delivers the subject of the verdict to the popular jury – something that will happen on Monday -, the Prosecutor’s Office and the accusations presented in the trial maintained the requests for sentences of between 22 and 27 years in prison for the five accused. For the person who initiated the attack, thinking that the victim was recording him, Diego MM, and for his then girlfriend, Catherine SB, 25 years in prison are requested for murder with treachery and cruelty and aggravating discrimination due to sexual orientation of the victim. In the case of the young woman, they propose a subsidiary classification as an accomplice to the crime of murder for “facilitating the actions” of the others involved. In this case, the proposed sentence is 14 and a half years.

Alejandro FG, known as Yumba, and Kaio ASC are attributed “active participation” in the events, for which they request 22 and 27 years in prison, respectively. For the second it is five more years because the crime of robbery with violence of the victim’s cell phone is added.

For Alejandro MR, whom witnesses placed at the heart of the attack, but did not see him hit, they ask for 22 years in prison. As in the case of Catherine, they introduce a possible subsidiary qualification as an accomplice to murder that would carry a sentence of 13 years in prison.

The defenses, for their part, lower the grades and penalties in their considerations. Diego MM’s lawyer believes that the facts should be considered homicide due to serious recklessness and the crime of injury, with a sentence of two years in prison and one, respectively. If this is not considered, he alternatively requests homicide with aggravated abuse of superiority, with a sentence of ten years in prison.

The defenses of Alejandro MR, Catherine SB and Kaio ASC have maintained their request for acquittal of the crime of murder. The lawyer of the first of them raised a subsidiary crime of injuries. Kaio’s defense admitted the appropriation of a cell phone, but denied that he knew it belonged to the victim and requested a crime against property for this.

Alejandro FG’s lawyer maintained that the mitigating or defense of psychological alteration due to a mixed personality and hyperactivity disorder, in addition to intoxication due to consumption of alcohol and cocaine that day, is present. In his case, he raised a crime of injuries and, if not estimated, reckless homicide or manslaughter. He indicated that he does not see aggravating factors, but, if there were any, it would be an abuse of superiority.
