The Prosecutor’s Office affirms that the State violated the rights of migrants evicted from a reception center in Alcalá de Henares

The Prosecutor’s Office of the National Court (AN) has concluded that the Public Administration violated the rights of migrants evicted from a reception center in Alcalá de Henares (Madrid) last January and has requested that it be declared contrary to international human rights law. and the fundamental right to physical and moral integrity that migrants in irregular and particularly vulnerable situations are abandoned.

As reported by the Public Ministry in an information note to which Europa Press has had access, the Prosecutor’s Office of the National Court has made its request in coordination with the Human Rights and Democratic Memory Unit of the State Attorney General’s Office in response to the actions of the Secretary of State for Migration.

Specifically, the prosecutors are acting following a lawsuit from the Spanish Immigration and Refugee Assistance Network Association in which it was reported that in January 2024 the Public Administration had evicted a man from a reception and referral center in Alcalá de Henares. group of migrants in an irregular administrative situation and special vulnerability, leaving them in a state of illegality and abandonment.

The procedure is processed before the Fourth Section of the Administrative Litigation Chamber of the National Court based on the complaint of said association for alleged violation of the fundamental right to life, physical and moral integrity, freedom and security and effective judicial protection.

The association assured that the reported case affected migrants coming “mostly” from the “sub-Saharan geographic environment, who in 2023 entered Spain in an irregular administrative manner through the Canary Islands.”

According to the complaint, the Public Administration expelled them from the center “without providing them with a solution or guidance regarding their legal situation in Spain” or a housing solution or “any means of subsistence.”

In the document from the Prosecutor’s Office of the National Court to which Europa Press has had access, prosecutor Manuel Campoy defends that the defendant Public Administration violated “the fundamental right to physical and moral integrity of the migrants concerned” by “generating a situation of relevant risk of injury” for them.
