Former judge and senator elected by Paraná, Sergio Moro (União Brasil), said this Monday (24.Oct.2022) that the resignation from the judiciary was “inevitable” as “dismantling” of the Lava Jato operation. He was responsible for the investigations of the Operation in the 13th Federal Court of Curitiba (PR) until he was appointed Minister of Justice in the government of the President. Jair Bolsonaro (PL), in 2019.
“We expected that the political system, in the face of those corruption scandals, would do its part – that is, pass stricter laws and increase transparency mechanisms”said Moro in Flow Podcast alongside the ex-prosecutor and elected federal deputy Deltan Dallagnol (We can-PR). “And then the path of politics becomes inevitable”said the former minister.
Dallagnol also justified his departure from the position of prosecutor at the Federal Public Ministry. by the reaction of the political class to the Operation. He was the most voted federal deputy candidate in Paraná in 2022, with 344,917 votes.
“After seeing all Lava Jato destroyed, I called my wife and said: ‘my love, we can stay in the Public Ministry with a good salary, with stability, with the prospect of retirement’”, he said. The former prosecutor considered, however, that the “best decision” would be “seek space in politics” for being the place where “change can be made”.
“The big decision of Lava Jato was this: we thought that the Justice was going to clean up politics, but we discovered that politics is what rules the justice, because politics is who chooses the ministers of the Supreme and politics is who makes the laws that justice applies”said.
REAPPROXIMATION WITH BOLSONARO
Both made reservations about the electoral rapprochement with Bolsonaro, with whom Moro has been broken since he accused the president of having committed crimes of responsibility and misrepresentation, in April 2020.
After the 1st round, Bolsonaro said he had “surpassed” disagreements with Moro and cast him as an advisor in the presidential debate at the Band, on October 16. In an interview after the event was broadcast, the Chief Executive suggested that Lava Jato would return to “to be a reality in the near future” and said that the former minister was one of those responsible for the “Brazil’s resurgence”.
According to Moro, the realignment is strategic and carried out in a scenario where “cannot be neutral” in the 2nd round dispute between Bolsonaro and the former president Luiz Inacio Lula da Silva (PT). He denied having made agreements to compose a possible 2nd term of the president or to obtain a nomination for a vacancy in the STF (Supreme Federal Court).
“I will not compose the government, I will not be a minister. I didn’t bargain for a seat on the Supreme Court. I will be an independent senator”said Moro.
“We have a common adversary: we see the return of Lula and PT to the crime scene as the worst thing that can happen to Brazil”said Dallagnol.
CHASE THE SQUID
Moro and Dallagnol denied having focused the Lava Jato investigations on Lula and criticized the PT’s claim that he had been acquitted of the convictions, canceled by the Minister of the Federal Supreme Court (STF) Edson Fachin, in March 2021. Moro called the process a “carpet”.
“When he [Lula] says he was exonerated, he was not. No court found him not guilty.”said Moro. “Lava Jato is not about Lula. Lula was one of the condemned. Lava Jato, in essence, dismantled a corruption scheme that was destroying Brazil, that was breaking Petrobras.”declared the former judge.
“All the cases went fast. It wasn’t Lula’s. Lula’s took longer than the average for the other cases. It didn’t have an undue, or non-standard, priority or speedup”said Dallagnol.
Moro said he had no personal problems with the PT member and said he imagined he was “even a sensible person”but charged a my fault for alleged corrupt practices committed over the years he was in the Presidency of the Republic.
According to the former judge, the PT’s victory would be a “moral failure” for Brazil and would bring economic instability due to the “bureaucratizing” of PT.
ASSOCIATION WITH THE CCP
moro questioned again Lula for not carrying out the transfer of leaders of the criminal faction PCC (Primeiro Comando da Capital) in 2006. At the time, PT and the then governor of São Paulo, Geraldo Alckminnow vice-candidate on the PT ticket for the PSB, retreated from the decision after a wave of riots coordinated by the PCC left hundreds dead in the state.
“With that protection, he [PCC] grew and expanded in the country. What was a São Paulo problem has become a national problem“, said. “What is your message? Now, if the government doesn’t have the courage to mess with this organization, if I’m a criminal, I’ll think: I want to be a part of it. This strengthened the CCP.”
WITHDRAWAL OF BEING 3rd WAY
The former minister also spoke about giving up the dispute to head the 3rd way of the presidential election. He tried to be a candidate for Podemos, but did not get the necessary support and migrated to União Brasil at the end of March.
“We tried to do what everyone asked: to have a 3rd way in the country so we don’t have to choose between extremes, to be able to escape polarization“, said. However, according to Moro, the lack of financial resources and television time and the internal orientation towards giving up discouraged him from continuing in the race.
“How am I going to stay in a party where we were being abandoned in that presidential candidacy?”he asked.
