The National Court suspends the Health order that limited the doctors who could perform cosmetic surgeries

The National Court has agreed to the precautionary suspension of the order of the Ministry of Health that limited cosmetic surgery operations to those professionals with specialized training. In an order, collected by Europa Press, the Contentious-Administrative Chamber upholds the request of the Spanish Association of Aesthetic Surgery and an individual, who had requested that the order be suspended as a precautionary measure.

Specifically, it specifies that the “care unit in which a doctor with a specialty in plastic, aesthetic and reconstructive surgery or another surgical or medical-surgical specialty in the field and competencies indicated in the official program of his specialty, is responsible to perform surgical treatments, with the aim of improving body, facial or hair aesthetics.

The magistrates explain that the Health order approved last September modifies the annex to Royal Decree 1277/2003 that establishes the general bases for the authorization of service centers and health establishments.

In this sense, they indicate that the purpose of this order is to prevent or hinder professional practice in Unit U-47 for graduates in medicine and surgery who are not specialists, which was not contemplated in the Royal Decree, since it did not contain any provision. on professional skills.
