Joaquín Gadea, magistrate of the National Court, has decided to charge Fernando Presencia, a former judge expelled from the race and convicted twice for prevarication. The instructor has made this decision after admitting for processing the complaint filed by the Prosecutor’s Office last week, when he accused Presence of crimes of libel and slander, and against the high institutions of the State for spreading hoaxes about Supreme Court magistrates and about the prosecutor General of the State, Dolores Delgado.
The public ministry maintains that the former judge, who heads the Association against Corruption and in Defense of Public Action (Acodap), spreads false information where he attributes to magistrates of the high court and Delgado a series of possessions in tax havens and the collection of bribes For the dissemination of these alleged hoaxes, Presencia relies on complaints that he promotes in court and that come to nothing, but that he discloses through the website of the group he leads, through which he also collects money. “Scandal in the Supreme! 9 of the 16 magistrates of his Criminal Chamber were caught with accounts in tax havens ”, reads one of the last publications he made.
Judge Gadea, who already ordered Presencia to be investigated in April to find out if it had fabricated “ex profeso” documentation to incorporate it into a complaint against former president José Luis Rodríguez Zapatero and against Delgado, considers that the information from the accused “presents clear criminal features and represents an illegitimate interference in the honor of those affected.” For this reason, in addition to ordering that it declare as investigated, the instructor has ordered the closure of the Acodap website and has asked the Civil Guard to prepare reports on the economic contributions received by this association.
