Lawyer Grivtsov allowed Deputy Defense Minister Ivanov to be released on parole
Arrested Deputy Defense Minister Timur Ivanov, released from office and suspected of corruption, may be released on parole if the court returns a guilty verdict, lawyer Andrei Grivtsov admitted. His words lead RIA News.
The lawyer recalled that until a court decision the defendant is considered innocent. As for the very possibility of parole for a person convicted under Part 6 of Article 290 of the Criminal Code of the Russian Federation (“Receiving a bribe on an especially large scale”), release is possible under Article 79 of the Criminal Procedure Code after serving at least two-thirds of the sentence.
Grivtsov clarified that such a decision is made by the court, taking into account the behavior of the convicted person, his attitude to education and work, rewards and penalties, as well as his attitude to the crime committed, the fact of compensation for damage in the case and repentance.
The lawyer especially emphasized that the discussion of the issue of parole for Timur Ivanov can only be hypothetical, since the verdict has not yet been pronounced, and according to the Russian Constitution, the suspended deputy defense minister is currently innocent.
Earlier, lawyer Eduard Isetsky admitted that Ivanov’s seized property could be returned to him after the verdict. The defender explained that such a development of events is possible in two cases.
The Deputy Minister of Defense was arrested at the end of April. He was detained at his workplace. According to investigators, the deputy minister entered into a criminal conspiracy and, as part of an organized group, received property benefits from contracting and subcontracting work for the needs of the military department. Ivanov was charged under Article 290 (“Receiving a bribe on an especially large scale”) of the Criminal Code of the Russian Federation. He did not admit his guilt.
