The judge of the Court of Instruction number 4 of Tarragona has admitted the complaint of the Gimnàstic de Tarragona against the referee Eder Mallo Fernández, who whistled the match against Málaga in which the Andalusian team frustrated its rise to second division with a goal to a few seconds from the end (2-2).
The magistrate understands that “the facts reported in the complaint of Querella possess enough entity to be constitutive, at least indicate, of a crime of documentary falsehood of art. 390.1.1 of the Criminal Code and a crime of corruption in the sport of art. 286 bis ”, as the writing says.
The complaint, advanced by The avant -gardehe maintained – by providing documentary tests, including the recordings made by the Detective Agency of Francisco Marco, Method 3 – that the referee lied when in the arbitration act he assured that he had feared for his physical integrity after the final beep, in his locker room, in his locker room, in The Nou Estadi. For this reason he accuses him of a crime of documentary falsehood.
The insults and threats described by the referee in the minutes were the main argument for the Royal Spanish Football Federation (RFEF) to sanction the Nàstic with the closure of its four games stadium and with a fine of 9,000 euros.

The magistrate considers that there are indications of crime since the letter of the complaint provides evidence of a private investigation carried out by the Nàstiuc.
