The Central Electoral Board (JEC) has agreed to open a sanctioning file against both the PSOE of Madrid and the spokesperson of the same party in the capital’s City Council, the former minister Reyes Marotofor having supported the PSC candidate on social networks, Salvador Illaon the day of reflection for the elections to the Parliament of Catalonia, something that is expressly prohibited in the Electoral Law.
It consists in this way in two resolutionsto which Europa Press has had access, both relating to messages posted by the accounts on the social network ‘X’ of Maroto and the PSOE-M. In said ‘tweet’ the silhouette of Salvador Illa and the slogan “Salvador” appear, and in both cases, both the PSM account and Reyes Maroto herself, spread this message with the electoral campaign closed, the day of reflection of the Catalan elections of May 12.
The PSOE of Madrid had indicated that it withdrew the publication and that, furthermore, it did not participate in those elections and that its publication, in addition to not calling for a vote, was not in contradiction with article 53 of the LOREG. In his opinion, the messages were a “gesture of affectionaffection and personal conviction”.
A fine of 300 to 3,000 euros
In both cases, the Prosecutor’s Office advocated archiving the issue, but the Central Electoral Board understands that it is prohibited propaganda expressly by legislation, given that it is done during the day of reflection.
In the case of the PSOE of Madrid, which was denounced by Vox, the resolution indicates that the events could constitute an electoral infraction with a fine of 300 to 3,000 euros.
As for the spokesperson at the Madrid City Council, who was denounced by the PP, the JEC also understood that the image of the silhouette, having been used in the election campaign could constitute an act of propaganda on a prohibited day.
The files will be investigated by two Supreme Court justices who are part of the JEC, a mixed body made up of High Court judges chosen by lot and jurists proposed by Congress.
