The Ministry of Territorial Policy and Democratic Memory has issued a resolution in which “declares illegal and illegitimate” the court that judged the anarchist activist Salvador Puig Antich, and “illegitimate and null the conviction” to death in 1974.
The resolution, dated from January 30, 2025, signed an open process last fall, when Minister Ángel Víctor Torres gave the Puig Antich family a title in which he was declared “victim of persecution and political violence.” The document issued this January and advanced by ‘El Punt Avui’, specifies the nullity of the War Council and the sentence that was derived.
The brief ensures that Puig Antich, which was part of the Iberian Liberation Movement (Mil), “suffered persecution for political and ideological reasons during the Franco dictatorship.” During his arrest, on September 25, 1973, there was a shooting that caused injuries to the face and shoulder, of which he had to be operated.
The text recalls that he entered a model prison in Barcelona, was tried in a war council, sentenced to death and executed by the vile club method on March 2, 1974. Puig Antich “has the right to recognition and to obtain moral reparation and The recovery of your personal, family and collective memory ”, as the resolution says.
In the operative part of the document, and in application of the provisions of the Democratic Memory Law, it is provided that “the Court that judged Salvador Puig Antich, as well as the jurors and other criminal and administrative bodies that , from the coup d’etat of 1936, they would have been constituted to impose, for political reasons, ideological of religious consciousness or belief, sentences or sanctions of a personal nature. ”
In a second point “the conviction, sanction or resolution issued against Salvador Puig Antich is declared equally illegitimate and void. For all this, the minister issues the “declaration of recognition and personal reparation.”
The document does not refer to the death of police Francisco Anguas due to the shots received in the shooting, does not specify the crime of terrorism for which Puig Antich was convicted, nor does it enter the irregularities that the family denounces that they were committed in the process judicial.
The resolution is the result of a brief that the family addressed to the ministry after the first repair document was given in autumn. It was a title that did not satisfy the relatives of Puig Antich because, on the one hand, the judicial cause was cited erroneously, referring to summary 106/73 when 106-IV-73 had to be written, and, on the other, not There was the date on which it had been issued.
In addition, although in that first document Puig Antich was given the consideration of a victim of political harassment and reference was made to the Democratic Memory Law that declares the judgments void as a result of these practices, in no case was decreasing clearly and explicitly The nullity of the War Council to Puig Antich.
The family’s brief to the ministry requested an amendment to the title, for considering it wrong and incomplete, and a clarification about the need for them to issue a document in which the nullity was specified, as has happened now. In the letter sent in his day to the Ministry it was remembered that in the cases of the files of nullity of the processes to Lluís Companys and José Luis Sánchez-Babovo Solla, member of the frap, a motivated resolution and unequivocal content had been issued.
The Ministry already corrected the title at first, correctly writing the numbering of the cause and providing date in the document, and has now completed the procedure. With this letter, the government’s own institution that on March 1, 1974 gave the death sentence good and activated the execution of Puig Antich amends and declares the nullity of the entire process.
The repair in Puig Antich is produced in the moral, personal and family, but in no case gives rise to urge a patrimonial claim. In the legal field, the minister’s resolution must now be attached to the judicial process file.
