The Government approved this Tuesday in the Council of Ministers the new Regulation of the Immigration Law with which it intends to regularize up to 900,000 immigrants in three yearsat a rate of 300,000 people a year. With this regulatory change introduced by the Executive “procedures are simplified, duplications are eliminated and greater guarantees and legal rigor are provided.”
This was announced by the Minister of Inclusion, Social Security and Migration, Elma Saiz, at a press conference after the Council of Ministers. Likewise, he explained that improvements to European regulations are being introduced, promoted under the Spanish presidency of the semester. «The regulation will serve to fight mafiasto combat fraud and to combat the violation of rights,” he stressed.
Regarding the needs of the labor market, Saiz has indicated that a specific section is created within the standard that includes both the short-term and long-term visas“to make it more easily understandable.” In this sense, he has also added that the procedures are “simplified” and the powers between consulates and immigration offices are “delimited.”
On the other hand, he celebrated that the new regulation reduces bureaucracy. “From now on all initial authorizations will be for one year and renewals will be for four years,” he stressed.
Another novelty is the regulation of the job search visafor which he has said that its validity is extended from three to twelve months, with the aim that “foreign companies get a job appropriate to their professional profile and, at the same time, that companies find the professionals they need.” .
Regarding the roots, Saiz has indicated that the new regulation has five types of roots: social, socio-educational, socio-laboral, family and the roots of a second chance. «The novelty is that they are homogenized and the time spent in Spain is reduced from three to two years. The requirements to be met are made more flexible and you are enabled to work not only as an employee, but also as a self-employed person from the very beginning,” he stated.
Along these same lines, the minister explained that at the end of 2023 there were 210,334 people with authorization for roots, 84,983 more than in 2022. “We have estimated that with this reform they can be regularized on average 300,000 people a year during the next three years,” he assured, adding that from 2022 to 2023, people regularized by roots affiliated with social security have increased by 30.4%.
Likewise, Saiz has highlighted “that a prosperous society must know how to form and capture talent». For this reason, he has said that in terms of training, people subject to this regulation will be able to enjoy a stay authorization for studies that lasts as long as their training lasts.
In addition, he explained that the new regulation “facilitates” a fast track to be able to obtain a work authorization once the studies are completed. During their studies, they will also be authorized to work a maximum of 30 hours per week and regardless of the training they are taking.
He has also pointed out that it reinforces the requirements and obligations of study centers. “We ensure that they (students) obtain decent and sufficient training and prevent them from being victims of fraud.” “In short, the regulation opens doors that were previously closed by three keys, training, employment and family,” he stressed.
