He European Committee of Social Rights (CEDS) has declared admissible a claim from the Galician Intersindical Central (CIG) regarding the interprofessional minimum wage (SMI) of 2023it was reported this Tuesday.
The decision is among those adopted by the CEDS (an organization of the Council of Europe) at its plenary meeting last week in Strasbourg, and which were disclosed this Tuesday.
Following this decision, the CEDS will study the allegations in order to resolve in the future on the merits of the collective claim presented by the CIG.
The Galician union presented its claim in October 2023. In it, it alleged that the minimum wage of that year, established in a royal decree of February 14 of that same year, “it is not enough to guarantee a decent standard of living for workers and their families”.
This would constitute a violation of article 4.1 of the European Social Charter, which establishes that all workers have the right to equitable remuneration that ensures them, as well as their families, a satisfactory standard of living.
The Spanish Government requested that this claim not be accepted for processing, since the CIG, being a regional union, “cannot be considered as a union national representative” and, therefore, cannot present a collective complaint before the committee.
However, the CEDS considered that the CIG “is a representative trade union organization for the purposes of the collective claims procedure” and accepted the complaint for processing.
