He Nastica First Federation team, has reported through its official media that the Court of Instruction Number 4 of Tarragona has accepted the complaint against the referee for processing Eder Mallo Fernandez for facts that could constitute a crime of falsification of documents under article 390.1.1 of the Penal Code and a crime of corruption in sports under article 286 bis.4 of the Penal Code.
As ABC reported at the beginning of December, Nástic is the first football club to have presented a criminal complaint against a referee, specifically against Eder Mallo Fernández, who directed the second leg of the promotion promotion final against Málaga on June 22.
The Tarragona club decided to resort to criminal proceedings after an investigation by the Method 3 detective agency concluded that the aforementioned referee acted “premeditatedly” to harm Nàstic.
The order issued by the Court of Instruction Number 4 of Tarragona, which was notified this Monday, states that “the facts reported in the complaint document have sufficient substance to constitute, at least indicatively, a crime of document falsification of the art. 390.1.1 CP and a crime of corruption in sport of art. 286 bis.4 CP.
In the order of the aforementioned court it is indicated that the complaint filed shows evidence of the commission of the two crimes that Nàstic points out: document falsification and another of corruption in sports.
Nástic adds that, after receiving this notification, it will continue to defend the dignity and honorability of the entity and Tarragona.
