The Ministry of the Interior, Emergencies and Territorial Planning, through the General Directorate of Territorial Planning and Urban Planning, has approved the exceptional flood regime so that it can be built, with a series of requirements, in a Preferential Flow Zone (ZFP).
Once the binding and favorable reports from both the Segura Hydrographic Confederation (CHS) and the General Directorate of Security and Emergencies, as well as the Territorial Planning Service of the General Directorate of Territorial Planning and Urban Planning, have been issued, the to the issuance of the Resolution, which recognizes the special regime of the municipality in matters of flood risk.
Thanks to the new regime, which is directly applicable to all urban planning files in the municipality of Murcia, it will no longer be necessary to include the corresponding technical justification in the processing of each file.
The application in the municipality of Murcia of the special high flood regime has been carried out in application of article 9 quater of the Hydraulic Public Domain Regulation (RDPH). This article contemplates the possibility of declaring a special regime to allow the development of new buildings or associated uses in the Preferential Flow Zone (ZFP) by complying with a series of requirements, such as being located outside the police zone; not increase the existing flood risk; or not increase the vulnerability of the security of people or property against floods.
