The Court of Instruction number 38 of Madrid has summoned comedian Héctor de Miguel, known as Quequé, to testify on December 11 as a defendant for an alleged hate crime, for joking on his Cadena SER radio program about dynamiting the Valley of the Fallen and stoning pedophile priests.
The summons comes after a complaint by Christian Lawyers against the comedian was admitted for a crime of provocation to discrimination, hatred and violence (covered in article 510.1 of the Penal Code). The ultra association’s argument is that it “encouraged” in its Cadena Ser program to “dynamite the Valley of the Fallen and stone pedophile priests at the doors of churches and monasteries.”
The comedian addressed Christian Lawyers directly in his joke. “All of these people here have one wish: to fill the cross in the Valley of the Fallen with dynamite. And blow it up into the air,” he began. “If it can be a Sunday, the better, so that more people can go. And then, Mr. Judge, [vamos a] take all the little pieces of the cross and in the same way as you [por Abogados Cristianos] “You go to the clinics to harass women who are going to have an abortion, we will go with the stones to the churches to throw them at priests who have fucked a child.”
Christian Lawyers has become, together with Hazte Oír, one of the loudest ultra-conservative associations at this time in Spain. A month ago, the judge placed Echenique on the verge of the bench for a tweet about priests and pedophilia after a complaint from this ultra organization.
I should have appeared on the 16th but it was not
In the ruling by which he is summoned, it is stated that Miguel Martín had to have appeared in court to transfer the complaint to him on the 16th, although, and despite having called him by phone and it being proven that it had been Once that first summons was delivered, he finally did not appear.
“Having not appeared today the defendant Héctor de Miguel Martín (cited in legal form), for the purposes that were agreed upon (transfer of complaint and request), it is agreed to summon him, through the National Police (Unit Attached to the Investigative Courts of Madrid), for these purposes on October 30, 2024 at 10:30 a.m.,” indicates said resolution, to which EFE has had access.
To this appointment, the court adds the appointment for the defendant’s statement on December 11 at 9:30 a.m. in the presence of the rest of the parties (Prosecutor’s Office and accusation).
