The 71-year-old affected says he fears for his life and asks that the suspect be prevented from also approaching his family
Javier IA, the accused of stabbing his neighbor in the head with a ham knife, confessed to the National Police that he had “lost control.” This Colombian, 58 years old and living in the Molinense urbanization of Altorreal, stood on the 18th at the police station and acknowledged having attacked another 71-year-old resident of his building with a knife.
It was in the community garage in Plaza Portales where the two met and, apparently without saying a word, the accused stabbed his neighbor several times. The victim, according to him, had gone down to the storage room to make some arrangements and met Javier, who greeted him normally. Barely a minute later he returned to the place. “He appeared surprisingly while his back was turned,” said the affected person in his statement to the Police. “In an aggressive voice he told me ‘now let’s talk'”. Later, according to his version, he stabbed her in the face and neck despite her attempt to defend herself against him.
Some disagreements had arisen between them due to the victim’s dogs, which, the defendant assured, caused a lot of trouble in the neighborhood. That day, Javier maintained in his first statement, he intended to reproach him for the problem generated by his dogs and the fact that he played the saxophone at odd hours. The defendant maintains that the injuries were caused during the struggle and that he was not aware of where they were produced. After the attack, he took over, left his neighbor lying on the ground, went up to his house, changed clothes and left the house. Shortly after, he reconsidered and turned himself in at the police station.
The victim also acknowledged that there had been friction between them. According to THE TRUTH, she explained to the agents that Javier recently threw food for his dogs in his yard and that he thought he could carry poison. A circumstance that made her ugly.
“Important resistance”
The defendant entered provisional prison at the end of March accused of an alleged crime of attempted murder. The judge, in his car, held that the accused intended to end the life of his neighbor. The magistrate considers that there are indications that the defendant “acted with the intention of attempting against the life of his neighbor (…) not succeeding, however, due to the significant resistance that he offered at all times.”
The victim claims to fear for his life and demands that the defendant be given a restraining order that prevents him from also approaching his wife and daughter.
The defense demands that his imputability be analyzed
The lawyer Jorge Novella, who defends the defendant, maintains that the events that occurred in the garage of that Altorreal building do not imply a crime of attempted murder, like the one that the Police charged Javier IA with from the beginning. The lawyer, based on the supposed good state of health of the victim and the medical reports that indicate that his life was not in danger, argues that, in any case, it would be a crime of injury.
He has also requested an examination of the accused’s imputability by the coroner.
