He lawsuit that is taking place in the state of Texas against the Administration of the President of the United States, Joe Bidenabout the buoys installed in the Rio Grande of the southern border of the North American country, has promised to continue regardless of the illegal crossing migrant flow has decreased.
Greg Abbottgovernor of Texas, welcomed the ruling of the Fifth Circuit Court of Appeals which ruled on Tuesday night that the barrier his government installed on the Rio Grande in July of last year will continue and remain standing.
“We fought to keep these barriers in the water, and with the Fifth Circuit’s decision, that is exactly where they will remain. This fight is far from over,” Greg Abbott said in a statement.
It is worth noting that the Court’s decision overturns the ruling that was issued by a three-judge panel of the aforementioned court, as well as the order of Judge David Ezra, which was issued on September 6 of last year to remove the section of buoys.
It is worth mentioning that this would be the Texas’ first legal victory Regarding the installation of the floating barrier in the Rio Grande as a migration measure, after the demand of the United States Department of Justice which requests the removal of the buoys on the grounds that they constitute an “obstruction to the navigable capacity” of the also known as Bravo River.
That is why the governor of Texas has defended the installation of the barrier, indicating that he was forced to take measures on his own as a defense against an “invasion” of migrants, because the White House took steps to secure the southern border.
On appeal, Texas argued that Judge Ezra erred in concluding that the buoys posed an obstruction to the navigability of the Rio Grande and that he abused his authority to order the barrier’s removal.
“Texas will continue to defend our constitutional right to secure our southern border to keep our state and nation safe,” the president said in the statement.
However, the argument about the large flow of illegal migrants crossing the country’s southwestern border appears to be losing ground, following the restrictions that tighten applications for political asylum, which the Biden administration imposed last June.
It is important to note that arrests in July fell to levels of September 2020, with 56,000 arrests of foreigners who entered illegally through the southern border of the United States in that month, according to data revealed this Thursday by CBS.
It should be remembered that the Mexican government repeatedly asked the United States to remove the buoys, arguing that most of the barrier was in Mexican territory.
