Super League, the ruling of the Court of Madrid in contrast with UEFA and FIFA
The Super League achieves another victory. In December the decision of the Court of Justice of the European Union and now also the sentence of the Court of Madrid: “The titular magistrate of the Commercial Court No. 17 of Madrid has partially accepted the application presented by the European Super League Company SL (ESLC) against UEFA and FIFA and declared that both bodies have abused their dominant position and are preventing free competition in the market by granting itself the discretionary power to prohibit participation in alternative competitions and by imposing unjustified and disproportionate restrictions that violate articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU)”.
The ruling orders FIFA and UEFA “to cease sanctioning anti-competitive conduct and is prohibited from repeating it in the future, as well as ordering them to immediately remove all effects of anti-competitive actions that occurred before or during the duration of this proceeding, which began on 18 April 2021 when ESLC announced the launch of a project for a new professional football competition, called Super League , and has taken actions regarding the defense of competition in response to the reactions of the aforementioned institutions”.
