Minister Cármen Lúcia, of the Federal Supreme Court (STF), asked former president Jair Bolsonaro (PL) and deputy André Janones (Avante-MG) to inform whether they are interested in participating in a conciliation hearing in the action in which the parliamentarian is accused of slander and insult. The deadline for responding is 20 days.
The attempt at conciliation was a suggestion from the Attorney General's Office (PGR). The hearing takes place if at least one of the parties is interested. If both reject the proposal, the process continues.
Bolsonaro filed the lawsuit after being called a “jewel thief”, “militiaman” and “runaway bandit” in publications made by the deputy on X (formerly Twitter) between March and April of last year. Janones also attributed responsibility for thousands of deaths in the pandemic to the former president.
See the publications questioned:
“Trump has just confirmed that he will hand himself over to the police next Tuesday, the 4th, and the statement that the jewel thief militiaman will give to the PF will be a day later, on Wednesday the 5th!”
Today you are there getting ready for the holiday and the little jewel thief is getting ready to face the police. It’s the first of many scores that the fugitive criminal will have to settle.”
The killer who killed 4 children today in SC was inspired by another killer: Jair Bolsonaro! Luiz Lima, author of the massacre, maintained posts on his networks praising the 'captain' who killed thousands during the pandemic! Bolsonarism must be criminalized just like Nazism!”
On the one hand, Bolsonaro's defense claims that the posts offended his honor and that he was accused of crimes he did not commit. On the other, the deputy states that the statements are protected by parliamentary immunity.
The maximum penalties for the crimes of slander and insult, combined, reach two and a half years of detention. Bolsonaro asks that, in the case of Janones, the Court declare that the crimes were committed five times and consider the dissemination of the content on the internet as an aggravating factor. As a result, the maximum sentence could reach 16 years. The former president also requests compensation of R$20,000 for moral damages.
