BRASILIA (Reuters) – The plenary of the Federal Supreme Court (STF) formed a majority on Wednesday to nullify the effects of a 2020 decree by President Jair Bolsonaro that completely excluded civil society representatives from the Fund’s deliberative council. of the Environment (FNMA).
So far, nine ministers have agreed to a lawsuit filed by Rede Sustentabilidade that contested this modification made by the current government, arguing that the changes generated a disparity between the social sectors.
The nine magistrates followed the vote of the rapporteur of the process, Minister Cármen Lúcia, who last week had said that the change evidenced a “centralization that would be undemocratic”.
The majority of the STF also agreed with an addition made by Cármen Lúcia during the investigation of the process that annulled two other decrees. In this way, they re-established the presence of governors in the Legal Amazon Council and also in the Organizing Committee of the Amazon Fund.
Only minister Nunes Marques fully diverged from the majority vote. The trial was suspended and will resume on Thursday with the last minister to vote, the president of the Supreme, Luiz Fux. This is one of the actions that the STF judges in the so-called green package, a series of environmental cases that are on the agenda.
