Former members of the PMDF leadership were denounced by the PGR for omission during the invasion of the headquarters of the Three Powers
The 1st Panel of the STF (Supreme Federal Court) formed a majority this Wednesday (14.Feb.2024) to accept the complaint, making defendants and keeping former members of the leadership of the PMDF (Military Police of the Federal District) in prison, due to omission in the acts of vandalism on January 8, when radical protesters invaded and vandalized the headquarters of the Three Powers.
The ministers accepted a complaint presented by the PGR (Attorney General's Office) against 7 former members of the PMDF:
- Fábio Augusto Vieira, former general commander;
- Flávio Silvestre de Alencar, major;
- Jorge Eduardo Barreto Naime, colonel;
- Klepter Rosa Gonçalves, deputy general commander;
- Marcelo Casimiro Vasconcelos, colonel;
- Paulo José Ferreira de Sousa Bezerra, colonel; It is
- Rafael Pereira Martins, lieutenant.
The military police officers were accused of the following crimes:
- omission;
- violent abolition of the democratic rule of law;
- coup d'etat;
- qualified damage due to violence against the Union’s property; It is
- deterioration of listed heritage and violation of functional duties.
The rapporteur, minister Alexandre de Moraes, stated that those accused failed to act and adhered to the “coup purposes of the anti-democratic horde that attacked the Three Powers”.
“The facts contextualized in full show the conduct of a possible criminal organization whose one of its purposes is to destabilize republican institutions, especially those that can oppose illegal or unconstitutional acts in a constitutionally foreseen manner, such as the National Congress and the Supreme Court Federal, with the aim of overthrowing the democratic structure and the Rule of Law in Brazil”, declared the minister. The trial takes place at virtual plenary of the Court –in this modality, ministers cast their votes and there is no discussion on the topic–, which began on Friday (9.Feb).
The score is 3-0 to maintain the possibility of reviewing the benefit. Ministers Cármen Lúcia and Cristiano Zanin followed Moraes' understanding. All that’s missing is Minister Luiz Fux’s vote.
Currently, the 1st Panel is made up of 4 ministers – with the arrival of Flávio Dino at the Supreme Court, it will have 5 members.
