A Navy sergeant confused a neighbor with a criminal and shot him dead in São Gonçalo, in the metropolitan region of Rio, on Wednesday night. He was indicted for manslaughter (unintentional) by the Civil Police, but the Public Ministry of Rio (MP-RJ) will accuse him of intentional (intentional) murder. The change was announced this Friday, the 4th, during the custody hearing of the case, in which the Justice kept Bezerra detained and transformed the arrest in the act into preventive detention.
The change request was made by the Prosecutor’s Office. “The Public Prosecutor’s Office said that it requires the conversion of the arrest in flagrante delicto in preventive detention. In addition, it understands that the conduct imputed to the custodian does not conform to the capitulation imputed by the police authority, that is, article 121, §3. of the 5th Criminal Court, responsible for the hearing.

Sergeant Aurélio Alves Bezerra was inside his car, stopped in front of the gate of the condominium where he lives, at Rua Capitão Juvenal Figueiredo, in the Colubandê neighborhood, around 11 pm on Wednesday. As the remote control of the gate didn’t work, he waited for the woman to open it to store his car. Meanwhile, Durval Teófilo Filho, a 38-year-old black man, walked up to the car.
Teófilo Filho was returning from work as a supermarket replenisher and lived in the same condominium as Bezerra. As he was getting home, he rummaged in his backpack in search of the key. Seeing him passing and rummaging through his backpack, the sergeant pulled out his gun and fired in his direction. Shot in the chest, the repository fell and raised his arms in surrender. Still, Bezerra fired twice more. Then he approached and found that the victim was not armed. Teófilo Filho would have said that he lived there.
The sergeant took the neighbor to the nearby Alberto Torres State Hospital, where he died, and Bezerra was arrested in the act. To the police, he said he was scared of the victim, thinking he was a robber.
Teófilo Filho’s wife, Luziane Teófilo, told TV Globo that the couple’s 6-year-old daughter saw the scene through the window and identified her father. For her, the sergeant fired because the man approaching was black. “Seeing the cameras, listening to the deputy’s speech and from what the neighbors are saying, I’m sure that this happened because he is black. Even though he was a resident of the condominium, the neighbor didn’t want to know. For me, it was racism, yes,” he said.
