PEC wants occupied coastal areas to be purchased by individuals for payment, or transferred to states and municipalities
The CCJ (Committee on Constitution, Justice and Citizenship) of the Senate will hold a public hearing this Monday (May 27, 2024), at 2pm, to discuss the PEC (proposed amendment to the Constitution) 3/2022which removes possession of the so-called “navy lands” from the Union.
Navy lands are areas of the sea coast measuring 33 meters from the sea to the continent. They are located on the sea coast and on the banks of rivers and lagoons.
According to the proposal, people who occupy the land will be able to acquire it for a fee, while States or municipalities will have the property transferred to them free of charge.
“The proposal distributes these properties among States, municipalities and individuals. However, considering that the proposal seeks to amend the Constitution to modify the ownership of marine land, currently belonging to the Union, and its extinction could impact the Union’s General Balance Sheet and the Union’s current revenues, it becomes essential that the matter is debated and improved in a public hearing”, said the senator Rogério Carvalho (PT-SE) on application in which it proposes the holding of the public hearing. The text of PEC 3/2022, which originated in the Chamber of Deputies, repeals item VII of article 20 of the Federal Constitution and paragraph 3 of article 49 of the Transitional Constitutional Provisions Act. The matter has a favorable opinion from the senator Flavio Bolsonaro (PL-RJ).

The commission awaits confirmation of the participation of the governor of Amapá, Clécio Luís Vieira (Solidarity), and the mayors of Florianópolis (SC), Topázio Neto (PSD); from Belém (PA), Edmilson Rodrigues (Psol); and Manaus (AM), David Almeida (Forward).

The Senate offers a declaration of participation, which can be used as an hour of additional activity in a university course, for example. The e‑Citizenship Portal also receives citizens’ opinions on projects being processed in the Senate, as well as suggestions for new laws.
