BRASÍLIA (Reuters) – Rapporteur of requests for annulment of the presidential pardon to deputy Daniel Silveira (PTB-RJ), Federal Supreme Court minister Rosa Weber decided not to analyze the actions and send them directly to the court’s plenary.
There is still no date set for the trial.
In her decision, the minister claimed that the four actions that deal with the issue, filed by various political parties, have “relevance and special significance for the social order and legal security” and, therefore, must be processed directly in plenary, to be decided by the 11 ministers.
Rosa Weber also gave the Planalto Palace 10 days to explain the individual pardon granted to the parliamentarian, sentenced by the STF last week to 8 years and 9 months for threats to democracy and the court. The Attorney General’s Office (AGU) and the Attorney General’s Office (PGR) must also manifest.
Daniel Silveira was convicted last Wednesday, by 10 votes to 1, after being denounced by the PGR for attacks on the STF and the democratic system.
The following day, during the holiday, President Jair Bolsonaro edited an individual pardon decree, specifically benefiting Silveira, and opening another crisis with the STF.
Four Arguments of Noncompliance with a Fundamental Precept (ADPFs) were immediately filed by PDT, PSOL, Cidadania and Rede Sustentabilidade, asking for the suspension of the presidential decree and questioning the fact that it had been published even before the conviction had become final.
So far, STF ministers have avoided any comment on the decree in order not to increase the crisis.
