Anab and the Workers’ Party filed a public civil action in the Federal Court asking for the suspension of the process
Anab (National Association of People Affected by Dams) and PT (Workers’ Party) filed a Public Civil Action in the Federal Court of the Federal District asking for the suspension of the Eletrobras privatization process. The document was presented on April 4, before the presentation of the 2nd opinion of the TCU (Union Court of Auditors) on the modeling of the company’s Union share offering. The association and the party ask that the privatization process of the state-owned company, which is still in TCU and will be tried on the 18th of May, be resumed only after the ring (National Electric Energy Agency) to present the Analysis of the Regulatory Impact with the tariff impacts of privatization for the consumer, followed by a public consultation in the molds of Brazilian legislation.
“Therefore, the requested Regulatory Agency, by remaining silent, even in the face of the provocation of parliamentarians and the TCU itself and failing to present the Regulatory Impact Analysis and robust studies on the tariff impact of the privatization of Eletrobras for the consumer, acted in an offensive way. public interest, in manifest violation of its legal duties.”says the action text.
Anab and PT also claim that Aneel, by failing to inform the tariff impacts of the privatization of Eletrobras, also offends the principle of publicity and transparency, since it is its responsibility to provide this information to Brazilians.
The party’s and Anab’s claim go against part of the minister’s arguments Vital do Rego to ask for a view of the process –more time for analysis– of the TCU (Union Court of Auditors) agenda.
The minister presented the following arguments to ask for more time to review the case:
- methodological flaws that resulted in a potential underestimation of the value added to the contracts in the order of R$ 63 billion;
- Brazilian citizens will have to overpay their electricity bills, monthly and for years on end;
there is not enough maturity in the numbers and studies presented to minimally support the privatization of Eletrobras; - the cash flows presented by BNDES, in the last ten years of the period used, which goes until 2051, register a reduction of investments until reaching the null value.
THE Power 360 contacted Aneel and Eletrobras to comment on the allegations in the lawsuit, but the agency and the company declined to comment on the case.
