The video game industry, unfortunately, is no stranger to lawsuits for abuse of power. Although we usually see these cases in Western companies, on this occasion it has been made known that Nintendo was found guilty of a “power harassment” lawsuit from two nurses, and now must pay a $1,300 fine.
“Power bullying” is described as “any type of behavior in which a superior takes advantage of his or her position in the workplace to cause physical pain or emotional distress to colleagues.” On this occasion, it has been revealed that two nurses stated that they were sent to Nintendo as part of a program that would give them regular employment, but they ended up being denied this due to a bitter relationship with their boss. The pair also claimed that the superior was the one behind this behavior.
As expected, the nurses started a legal process against Nintendo, and after a while, The court ruled in favor of the women regarding the proxy harassment claim.but did not agree with them being denied regular employment.
The two nurses originally worked at Nintendo for about five months, only to be denied permanent employment by their temporary employment agency because they “failed to establish a fluid framework of cooperation with the doctor,” i.e. their boss. Apparently, their superior did not greet them at work and only communicated with the two by emailwhich led to winning the power harassment case.
As a result, Nintendo will have to pay ¥200 thousand yen, or $1,300 dollars. At the moment, there is no official response from the Japanese company, and considering that we are talking about a not so big case, it is very likely that they will not do so. In related matters, Nintendo is suing the creators of Yuzu. Likewise, SEGA points to Nintendo as the culprits for the low sales of Sonic Superstars.
