I received a message from a reader saying:
I was involved in a traffic accident, at the end of December 2022, which resulted in a fracture to the left shoulder and other injuries in various areas of the body. I appointed a lawyer to plead in my favor against both the insurance company and the company that owned the vehicle whose driver hit me.
I agreed with the lawyer that he would receive 25% of the compensation as legal fees, and a month ago the court ruled in my favor for compensation of 60 thousand dirhams for the damages I sustained, with the defendants being charged the costs of the lawsuit and attorney’s fees, and after the lawyer inquired whether the court would oblige the plaintiff. They must pay all of his fees or only a percentage of them. He answered me that his fees will be deducted from the compensation and that the defendants will pay the lawsuit expenses only and nothing else. Is this correct?
the answer :
Legal advisor Dr. Youssef Al-Sharif said:
Yes, the opponent is the loser of the case. The court orders that he be obligated to pay the case fees and expenses and the attorney’s fees. Note that the attorney’s fees that the court rules are not the fees of the attorney assigned to the case because their value is usually five hundred dirhams or one thousand dirhams only, and it can be added to the amount executed. As for the fees The client’s lawyer is according to the fee agreement drawn up between the client and his lawyer, and a percentage of the amount awarded may be due upon implementation or according to the agreement.
