The 11th Civil Chamber of the Rio de Janeiro Court of Justice (TJ-RJ) sentenced Bolsonarist pastor Silas Malafaia, from the Vitória em Cristo Assembly of God, to pay R$ 100 thousand in compensation for moral damages to the federal deputy and candidate to the government of Rio de Janeiro, Marcelo Freixo (PSB). The judgment was unanimous. There is appeal.
Freixo sued the pastor for attacks he suffered in the 2016 campaign, when he ran for mayor of Rio. The deputy claims that he was the victim of a “smear campaign” in videos posted on YouTube. On tapings, he was called “left”, “immoral”, “indecent”, “cynical”, “liar” and “underhanded”. Malafaia also accused Freixo of being “in favor of erotic booklets in schools”.
In August 2020, Judge Rossidelio Lopes da Fonte, from the 36th Civil Court of Rio de Janeiro, sentenced Malafaia to pay R$15,000 in compensation. Lawyer João Tancredo, who represents Freixo, appealed to increase the value.
On trial last week, judge Fernando Cerqueira Chagas, the rapporteur of the case, said that the pastor intended to harm the honor and harm Freixo’s electoral campaign.
The judge took into account that Malafaia is a “public person of national expression and a religious leader widely known by society” and that the attacks were made on social media for thousands of people.
“It is noteworthy that the fact that the author and the defendant have antagonistic positions in political doctrine does not grant the right of one to offend the other and make statements with a clear injurious intention, without useful informational content”, he wrote.
