The JUPOL union has been internally denouncing within the National Police for “years” the irregular appointments that the General Directorate of the Police makes to positions in Spanish embassies around the world. Now, the organization has taken the matter to the Superior Court of Justice of Madrid (TSJM)which on November 11 admitted its contentious-administrative appeal to be processed.
JUPOL sources consulted by this newspaper point out that “the regulations have not been complied with for a long time.” Positions are chosen through the process of free appointment, “but without the publicity and transparency measures established by law.” “They are very sweet stalls, one of the most popular. Some have complements of more than 4,000 euros per month“, say the sources, while denouncing “irregularities” in the appointments.
This October 8, the general secretary of JUPOL, Aarón Rivero, sent a letter to the General Directorate of the Police. In the request, he requested “cease the illegal action” which according to the organization is being carried out in “all” appointments of “jobs for operational security and support personnel in diplomatic missions and embassies”.
Specifically, JUPOL refers to the positions of basic scales, sub-inspection, head of operational security subgroup in embassies, head of operational security team in embassies, support personnel in embassies and operational security personnel in embassies. In “all of them,” union sources say, irregularities are being committed.
These are freely appointed positions. However, they require a prior public call which, according to the complainants, is not being carried out. “The provision procedure is not identified, nor the name, specific complement level, location of the positions, scale and category to which they correspond, the scale and minimum score required, if applicable, nor the requirements for the performance of each one of the positions,” Rivero denounced before the General Directorate of the Police.
Finally, JUPOL points out that “the allocations of positions that have been illegally being carried out They are not published in the General Order of the National Police either.l”. Sources from the National Police consulted by 20 minutes They do not deny all these statements. They limit themselves to saying: “We will follow what the courts say.” This newspaper has also consulted the Ministry of the Interior, where they have not been able to clarify the situation.
The TSJM, in the same document in which it admits JUPOL’s appeal for processing, requires the General Directorate of the Police to send “the administrative file of the common administrative procedure of public administrations.” Through a press release announcing the admission of the appeal for processing, JUPOL claims the need for “the provision of these jobs to be done taking into account the principles of equality, publicity, merit and capacity; and guaranteeing the transparency of the process“.
Far from this situation of transparency, the union continues, currently the process is carried out “in a manifestly illegal, arbitrary, inadmissible manner and without following the legal and regulatory procedure required.” According to JUPOL, the first step that the union took was “to present in the first instance a request through administrative channels, which, since it was not attended to by the General Directorate of the Police, has been raised in the form of a contentious-administrative appeal to justice.” “ordinary”.
