It is not, decided the Helsinki District Court and Court of Appeal.
Three men were sentenced to fines after they filmed prank videos in which they portrayed the company's employees and thus brought the company into a bad light.
The District Court gave its decision in July 2023. The Court of Appeal decided at the beginning of March that it would not grant permission for further proceedings, so the District Court's decision remains permanent.
Men's the list of actions was long and imaginative, although the same pattern was often repeated. The acts took place in 2020 and 2021.
The men were accused, among other things, of a violation of competition procedures, as two of them appeared as salespeople for Motonet and Jyski, for example.
They “served” customers and threw sarcastic remarks. In Motonet, they, among other things, sexualized products and suggested having an abortion with a windshield wiper.
In Jyski, they talked about their own masturbation and sexual experiences.
One of them also posed as an Avarn employee, while drinking alcohol and talking about his drug use. He also stopped cars on Porkkalantie, told unknown drivers to turn off the car, get out and told them that they were suspected or arrested for, for example, sexual abuse of a child and drunk driving.
The man had a beer can in his hand.
In the metro, the men filmed a video in which one of them posed as a ticket inspector for the Helsinki Region Transport (HSL) spraying a passenger's hand with a prank spray smelling of excrement.
One of the victims of the spray spill also sued the men. He said that he had, among other things, cracks in his skin.
The Helsinki district court considered that the men's entertainment was a business activity. They have received money from the videos.
About men two were convicted only of a competition procedure violation, but one was also convicted of a security violation, endangerment, minor damage, minor assault and defamation.
The man who received the most sentences in total received 70 daily fines, which made a total of 1,400 euros. In addition, he had to pay the victim of the subway prank EUR 300 as compensation for pain, soreness and other temporary inconvenience, and another EUR 300 for suffering.
The other two men received considerably smaller fines.
