Judgments | A group of men already attracted attention while shopping at Jumbo – Soon they attacked a teenager in Helsinki

Twelve men had their prison terms reduced from eight to five months for the assault, which took place in 2021.

Court of Appeal reduced the sentences from the gang assault in Pikku Huopalahti.

In the case, 15 men assaulted a 16-year-old in 2021. The gang first went to buy gloves and baseball bats, drove with the tools to Pikku Huopalahti in Helsinki, surrounded the young man and began assaulting him.

According to the Court of Appeal, all men participated in the events in some way.

The men also had edged weapons with them, including a machete.

Set had already attracted attention in the shopping center Jumbo, where they had bought the baseball bats. The shop assistants were worried about the purchases and called the police.

Some of the men had turned their phones off or on flight mode, which according to the court confirmed that they did not want to be located in Pikku Huopalahti at the time of the crime.

Baseball bats were apparently not used as an instrument of violence, but based on the marks left on them, they were still present at the time of the crime.

After the act, the men drove away in their cars, but the police stopped them on Mannerheimintie at Tullinpuomi Shell.

Court of Appeal dealt with the case for 13 people who appealed the sentence, but one of them withdrew his appeal.

The Court of Appeal considered a fair punishment for assault to be a five-month prison sentence. The district court had previously sentenced to eight months in prison.

One convict was sentenced to five months of unconditional imprisonment, and the other eleven convicts were sentenced to five months of conditional imprisonment.

The verdict was changed because the court of appeals did not consider the convicts to be responsible for knocking the victim to the ground or carrying out the act while masked with face masks and wearing rubber gloves.

Victim told the Court of Appeal that he himself had tripped on the ground while running away from the men. According to the Court of Appeal, the convicts may have had face masks because of the corona, not for the purpose of disguise.

The Court of Appeal agreed with the district court that the defendants had assaulted the 16-year-old together and had come together to the scene with the intention of using violence.

The Court of Appeal did not find out who did what to the 16-year-old, but according to the court, everyone was significantly involved in the abuse.

The large number of defendants formed a majority in the situation and made it difficult to identify the perpetrators.
