A federal court definitively confirmed that Elektra must pay 18,455 million pesos for a tax credit established for omitting the payment of ISR since 2013.
This is the largest tax debt of the eight that Elektra has and which totals 29,801 million pesos.
Since October 2020, a federal court had ratified the legality of that debt by denying an injunction requested by the Grupo Salinas company.
Two more tax credits from Ricardo Salinas Pliego’s company are close to being resolved in other courts, after the Second Chamber of the Court refused last September to attract four protections requested by the company.
Yesterday, by a majority of two votes to one, Judges Salvador Alvarado and Martha Ortiz voted to deny the protection, while Judge Fernando Silva García was the only one who agreed with Elektra.
Silva emphasized that in 2016, the SAT rejected the tax losses, but in 2018 it considered them valid, which he described as “an abusive and coercive practice” that he attributed to the authorities of the last six-year term.
After the ruling, Grupo Salinas anticipated that it will appeal to the Court. “We regret the lack of diligence and objectivity of some Magistrates, who, in the face of systematic pressure from the federal government and fear of being considered corrupt, refused to thoroughly analyze our protection,” he said in a statement.
