Iberdrola and Repsol will face each other this Thursday, November 21, in the Commercial Court of Santander in the lawsuit filed by the electricity company against the oil company for “unfair competition” and “misleading advertising” due to ‘greenwashing’.
The trial will take place in the city of Santander, since it is where the energy marketing subsidiary of the Repsol group has its headquarters.
Repsol tried to refer the matter to the Madrid courts by directing the case against the parent company, although the request was finally rejected.
Last February, Iberdrola filed a lawsuit in the Santander court against Repsol and its oil, electricity and gas product marketers, the latter identified as a direct competitor and which has its registered office in Santander.
The electricity company filed its lawsuit under the Deslea Competition Lawl, based on the articles of acts of deception (art. 5), misleading omissions (art. 7) and unlawful advertising (art. 18) within the framework of its advertising campaigns and corporate communications.
In the complaint, the electric accused Repsol of promoting sustainable initiatives, “when its multi-product offer seeks to promote the use of fuel”as well as “focus on sustainability, when it is a minor element of their current activities.
Furthermore, the group chaired by Ignacio Sánchez Galán considers that Repsol’s campaigns constitute “a violation of the Unfair Competition Lawby including acts of deception and misleading omissions regarding the company’s environmental commitment.
For his part, the CEO of Repsol, Josu Jon Imaz, assured that the lawsuit filed by Iberdrola revealed the “nervousness” of the electricity company and also stated that with this complaint he sought “limit the growth” of energy in the electricity sector.
“Repsol is not going to be distracted by a lawsuit from a company that is not used to competing in an open market.”but rather is used to moving in regulated environments that depend on the Official State Gazette. With this lawsuit, lacking a legal basis, the first thing they show is that they are nervous,” said Imaz on March 21 during a conference organized by Funseam and the Repsol Foundation called ‘Energy and economy, a binomial for the future’.
