The Ministry of Human Resources and Emiratisation revealed the arrest of 55 entities practicing recruitment and mediation activities without obtaining licenses from the Ministry during the past year, including five accounts on social media platforms that did not obtain the necessary licenses, in cooperation and coordination with the Communications Regulatory Authority and the Digital Government.
The Ministry took administrative measures against these entities by imposing financial fines on them and placing restrictions on them in the Ministry’s records in parallel with taking criminal measures against them by referring them to the Public Prosecution, while the accounts of the violating social media platforms were seized and blocked.
The Labor Relations Regulation Law prohibits practicing the activity of recruitment or temporary employment of domestic workers except after obtaining the necessary licenses from the Ministry. The law stipulates that the punishment shall be imprisonment for a period of not less than one year and a fine of not less than 200 thousand dirhams and not exceeding one million dirhams, or one of these two penalties for anyone who He practiced mediation or temporary employment of domestic workers in the country without a license in accordance with the provisions of the law, its executive regulations, and the ministerial decisions implementing them.
His Excellency Khalil Al-Khouri, Undersecretary for Human Resources Affairs, said: “Legislation criminalizes the practice of recruitment and mediation activity without obtaining licenses issued by the Ministry and in accordance with the procedures and requirements stipulated in the Law Regulating Labor Relations and its Executive Regulations and the ministerial decisions implementing them,” stressing that “the Ministry will not tolerate… Applying legal procedures and penalties against any company proven to be practicing this activity without obtaining the required license.”
He pointed out the effectiveness of the monitoring and follow-up system in controlling such violations, “especially in light of proactive monitoring by following up on the entity that announces recruitment or mediating employment in companies, verifying the data of this entity in the Ministry’s systems, and taking legal measures if it is proven that it is practicing recruitment or mediation activity.” Without obtaining licenses, this is in parallel with allocating inspection visits to the companies concerned to control illegal practices and take the necessary measures against them, including referral to the Public Prosecution to take criminal measures.”
Al-Khoury said, “The system works to monitor and follow up on the promotional and advertising campaigns that are circulated on social media, or any other means, to identify potential violations in the labor market, and that is within the tasks of the inspection sector in the ministry in monitoring the implementation of the law regulating labor relations and its executive regulations.” And the ministerial decisions implementing them.
He called on community members to ensure that the entity advertising employment or mediation obtains a license from the Ministry before dealing with it to ensure their rights and prevent fraud, and to report violations and illegal employment practices to the Ministry via the call center at 600590000 or the Ministry’s smart application.
