Last Thursday, the Congress of Deputies approved express trials for squatters and the expediting of housing recovery. The PNV managed to get the Plenary to approve the legal change in the Criminal Procedure Law (LECrim) which will allow evictions to be expedited in cases of occupation due to break-in, a modification that has gone ahead with the support of the PP, ERC and Bildu and despite the vote against by the parties that are part of the coalition Government. In this new scenario of ‘squatting’ in Spain the question arises about When the new measure comes into force.
This is an amendment introduced in the draft Law on the Efficiency of the Public Justice Service, approved in the Plenary Session of Congress with the support of the Government and its allies against the vote against the PP and Vox.
Specifically, the PNV amendment means modify article 795.1 of the LECrim so that the crimes of usurpation of residence (article 245 of the Penal Code) and trespassing (article 202 of the Penal Code) will be processed through the abbreviated procedure of judicial processes, the so-called quick trials, which will expedite their resolution and the evictions that may be ordered.
Support from ERC, Bildu and Junts
The PNV proposal has been rejected both in the presentation and in the Justice Commission, but it was approved in the Plenary Session of Congress thanks to the support of the PP, Junts, ERC, Bildu, UPN and CCovercoming the opposition of the PSOE, Sumar, Podemos and the BNG, while Vox has abstained, according to the voting list collected by Europa Press.
As the PNV recalled, the nationalist formation already introduced another amendment in the commission phase so that the Basque is established as a requirement in a quota of vacancies in the Administration of Justice in the Autonomous Community of Euskadi. This pact will serve to “serve Basque citizens more adequately and offer better public service to those who wish to exercise their right to express themselves in Basque,” they highlight.
When will it come into force?
Once the Congress process has passed, the document remains in the hands of the Senate. In the Upper House, the deadline to debate the proposal is two months. In this instance, 3 scenarios can occur: that the document be approved as it is, that it be vetoed by an absolute majority or that part of the text be modified.
Thus, the modification has already been introduced in the Justice Efficiency Law that has been sent to the Senate, where the PP has an absolute majority, so it is no longer expected to be revoked. If so, and in a period of 15 daysthe King must sanction, promulgate and order the publication of the law in the Official State Gazette (BOE).
