The Federal Consumer Protection Agency (Profeco) has issued detailed guidance on how consumers can cancel forced term contracts without facing penaltiespublished in Consumer Magazine.
This guide is especially relevant for telecommunications services, such as cell phone plansand offers a clear set of instructions for those who wish to terminate their services early, under certain conditions.

Profeco clarifies that, even under a forced term contract, Consumers have the option to cancel early.
How to cancel a forced contract without penalty?
The first step to carry out this cancellation is notify the service provideror, either through the means originally used to contract the service or any other alternative means.
It is essential that, at the time of cancellation, the consumer does not have outstanding debts with the provider.
If there are debts, the consumer must assume the conventional penalties specified in the contractwhich must not exceed 20% of the remaining total of the contracted service.
Additionally, if the equipment associated with the service was purchased in installments, the consumer has the obligation to pay the remaining balance or return the equipmentaccording to what is stipulated in the contract.
After completing these requirements, the supplier must deliver a cancellation document and refrain from making any additional charges.
For prepaid service users, the cancellation process is similar. They must contact their provider to inform them of the cancellation.
If the contract includes the return of any equipment, this must also be managed as agreed. Likewise, a cancellation folio will be provided and no additional charge should be made.
The guide also specifies the conditions under which consumers can cancel their contracts without facing any penalties.
These include: non-compliance on the part of the supplier, failure to install the service within the agreed period, unilateral modifications to the contract without prior consent and the termination of the forced term contract.
In cases where there is still an outstanding balance for equipment provided, this must be settled or returned as agreed in the contract.
