Genoa – Importing and marketing what were defined as “surgical masks” although without the CE mark, during the most acute phases of the pandemic, was not a crime, since they didn’t want to sell one product for another but simply describe it. Therefore both the entrepreneur who had brought them into Italy by storing them in a warehouse, and the shopkeeper who had put them up for sale, in a period in which there was an objective scarcity, must be acquitted.
