The governor of Rio Grande do Sul, Eduardo Leite (PSDB), will have to pay R$ 40 thousand in compensation for moral damages to singer and songwriter Chico Buarque. The determination is of the Court of Justice of Rio de Janeiro.
In a video by Leite, during the September 7 commemorations, the governor said he wanted to ‘put Brazil back to the center and mentions Chico, who is a PT supporter.
Last year, the court ordered the play to be deleted from social networks, according to a column by Mônica Bergamo from Folha de S.Paulo.
Eduardo Leite appealed of the lawsuit for moral damages, claiming that there was no violation because the singer’s image is already widely used, reported the Forum.

Judge Ingrid Charpinel Reis did not agree with Leite’s thesis and said that “freedom of expression and thought are a constitutional right, but the defendant exceeded the limit of his right by using the author’s image and name in an advertising campaign.”
“It is unacceptable to honor conduct in which the virtual world is transformed into a land without laws, without the hard-won constitutional guarantees”, said the judge.
