The National Driver’s License (CNH) is the most important document for anyone who wants to drive a vehicle in Brazil. Without it, it is impossible to go through a blitz and not pay a fine, in addition to having the car impounded. But do you know the conditions for losing the license?
Depending on the infraction, you can be up to 2 years without being able to drive.
+ How to deal with traffic when returning to face-to-face work?
The Brazilian Traffic Code (CTB) establishes some rules for fines that remove the right to drive a vehicle. The most common of these is the accumulation of points during 1 year, which used to be 20 points, but now has the current limit of 40 points in the year. This change took effect in 2021 and works as follows:
– Limit of 40 points, for the driver who does not commit any serious infraction in 12 months;
– Limit of 30 points, for the driver who commits a very serious infraction in 12 months;
– Limit of 20 points, for the driver who commits 2 or more serious infractions in 12 months.
Self-suspension infractions
Another way of suspending the CNH is through the so-called “self-suspension offences”. There are 20 in all and they fall into dangerous types of driving, such as driving while intoxicated, driving at speed 50% above the road limit, driving threatening pedestrians, racing, riding motorcycles with a helmet without a visor, among other cases.
When the driver is punished for losing his driver’s license, he can take a hook from 6 months to 1 year, with a worsening in the cases of recidivism within 1 year after the suspension period. In these cases, the driver can earn another 8 months without the document, or up to 2 years of standstill.
The CTB is not so direct when it comes to suspension time, and the transit authority will define the period. The criteria vary from case to case, but it is generally considered the seriousness of the offense, the circumstances in which it was committed, the offense and the driver’s background.
