The Minister of the Federal Supreme Court (STF) Flávio Dino named “pizza amendment” one of the mechanisms being used by the National Congress and the Palácio do Planalto to replace the secret budget. In a decision this Monday, the 17th, Dino called for a conciliation between the Legislature and the government of President Luiz Inácio Lula da Silva (PT) to deal with “full compliance” with the Court’s decision that overturned the irregular transfer of funds.
According to Dino, even with the Court’s decision, in December 2022, the distribution of parliamentary resources without transparency continued to occur between the Executive and the Legislative. The minister listed that the funds receive different “packaging” from that used in the secret budget, namely: “RP 2, RP 8 and “pizza amendments”. The secret budget scheme was revealed by Estadão.
“It is clear that the packaging or label does not matter (RP 2, RP 8, “pizza amendments” etc.). The mere change of nomenclature does not constitutionalize a practice classified as unconstitutional by the STF, that is, the ‘secret budget”, stated Dino in the decision.
This is the first time that the Judiciary has used the term “pizza amendment” in decisions on parliamentary amendments. The term suggests that the funds are being “divided into slices” and delivered to the parties.
As shown by the Estadãothe government, months away from municipal elections, continues to distribute resources to allies in Congress, without transparency, repeating a mechanism that marked the administration of former president Jair Bolsonaro.
“There is no doubt that the Legislative and Executive Powers have broad discretion regarding the destination of budgetary resources, which does not exclude the duty to comply with the principles and procedures contained in the Federal Constitution – including the postulates of publicity and efficiency . Without them, dark paths are opened leading to multiple forms of accountability, which we seek to prevent with the decision now handed down”, wrote Dino.
The conciliation hearing is scheduled for 10 am on August 1st this year. In addition to Dino, who will lead the meeting, the Attorney General of the Republic, Paulo Gonet, the president of the Federal Court of Auditors (TCU), Bruno Dantas, the Minister of the Federal Attorney General’s Office (AGU) will participate in the hearing. , Jorge Messias, the heads of the Chamber and Senate lawyers and the PSOL lawyer (the party responsible for the action that culminated in the ban on the secret budget in 2022).
