Colonel Meira (PL-PE), Gustavo Gayer (PL-GO) and Bia Kicis (PL-DF) are leading the initiative; they claim that the STF minister commits “abuse of power”
Opposition deputies are expected to present a new impeachment request against STF (Supreme Federal Court) minister Alexandre de Moraes on Monday (September 9, 2024), at 4 pm. The measure will be formalized in the Senate.
The deputies Colonel Meira (PL-PE), Gustavo Gayer (PL-GO) and Bia Kicis (PL-DF) are leading the initiative. There are around 150 congressmen who support the removal of Moraes from office in the Court.
They argue that the minister commits “abuse of power and violation of constitutional rights”. They also say that Moraes’ decisions and actions “threaten the federal constitution” and that Moraes interferes “unduly” in other Powers.
The impeachment process of a member of the Supreme Court is initiated by the Senate. It depends on the president of the House, Rodrigo Pacheco (PSD-MG), who is the one who can schedule the request in the plenary.
“Our Constitution has been disrespected on several occasions by decisions made by Minister Alexandre de Moraes. We need to preserve individual rights and fundamental guarantees of citizens, ensuring the Democratic Rule of Law”declared deputy Colonel Meira.
It was Moraes’ decision that blocked X (formerly Twitter) in Brazil. The deactivation of the platform in the country is also the target of criticism from deputies. On Saturday (September 7, 2024), opposition congressmen demonstrated on Avenida Paulista, in São Paulo, alongside the former president. Jair Bolsonaro (PL) for September 7, against the suspension of X and for the impeachment of Moraes.
There are other points mentioned:
- misuse of pre-trial detention;
- disrespect for opinions of the PGR (Attorney General’s Office);
- violation of the prerogatives of lawyers;
- denial of house arrest for people with serious health problems;
- violation of the political rights of congressmen;
- misuse of TSE (Superior Electoral Court) resources;
- monitoring and control of conservative profiles on social networks;
- blocking “illegal” from Starlink bank accounts;
- imposing disproportionate fines for the use of VPNs;
- and request for intervention by the United States Congress in internal matters.
The deputies reinforce that the presentation of the complaint is “essential to protect the Constitution, reestablish the limits between the Powers and correct abuses” attributed to Moraes. They defend the importance of combating any disrespect to the Magna Carta and ensuring the protection of individual rights and guarantees.
