Video circulating on social media asks the Senate to vote on a PL that ends the temporary release of prisoners on commemorative dates; Chamber approved project in 2022
A video circulating on social media this Monday (January 8, 2024) asks the Federal Senate to vote on the PL (bill) that extinguishes the benefit of temporary release for prisoners, known as “little girl”.
The text (PL 2,253/2022), approved by the Chamber in 2022, is stuck in the Senate Public Security Committee and awaits consideration. The video shows a photo of Roger Dias da Cunha, a military police officer who died on Sunday (7 January 2024) after being shot in the head by a detainee in “little girl”. In it, a voice pretends to be Cunha who, dead, asks the senators to evaluate the extinction of the benefit.

The senator Flavio Bolsonaro (PL) shared the video in his Telegram group. He said that the report he authored in favor of the project “It’s been ready for almost 7 months”. The senator criticizes the PT bench in the Upper House, stating that it “has used all the regimental devices to prevent it” voting on the text.
Earlier, the president of the Senate, Rodrigo Pacheco (PSD-MG), spoke out on X (formerly Twitter) about the police officer's death and the bill. Pacheco said that Congress will promote changes in the laws that “under the pretext of resocialization, they are serving as a means to commit more and more crimes”.
The governor of Minas Gerais, Romeo Zema (New) also criticized the “saidinhas”which he defined as “outdated laws”.
Understand the case
Cunha was 29 years old and was shot in the head during a pursuit of 2 criminals on Friday (5.Jan.2024). According to the g1the agent was chasing a car stolen by 2 suspects when a motorcyclist was hit.
The perpetrator of the crime, which led to the death of Roger Dias da Cunha, had been released for a temporary release from prison during the Christmas season, but did not return to prison until the deadline, on December 23, 2023.
The case raised criticism about the law of “little girl” and the lack of prestige of the agenda in the Senate.
The right to temporary exit without direct supervision is provided for by Criminal Execution Law, nº 7,210, of 1984. The guarantee is granted to convicts serving sentences in a semi-open regime. Authorization is given to activities characterized as:
- visit to family;
- attendance at a supplementary vocational and instructional course at 2nd grade or higher;
- participation in activities that contribute to the return to social life.
For 13 years, a proposal has been in progress in Congress to change the law and put an end to “saidinhas”. The law project 583/2011authored by federal deputy Pedro Paulo (PSD-RJ) was approved in the Chamber plenary in 2022. There were 311 votes in favor and 98 against.
