The wind around the spread of the corona virus in the ski resort of Ischgl 2020 is getting rougher: now a hotelier is being sued. He is said to have made false statements about the risk of infection.
Vienna – It’s been two and a half years since mass infections with the corona virus in Ischgl, Austria, caused a stir. The virus, which was still completely new at the time, spread rapidly in the popular ski resort. A German vacationer has now filed a lawsuit against a hotelier who is said to have incorrectly informed her about the risk of infection with Covid-19. The procedure is the first of its kind; the verdict could point the way for many of those affected.
Ischgl: Several lawsuits due to Coronawelle 2020 – Court of Appeal intervenes
Since the beginning of the corona pandemic, there have already been several lawsuits against the Republic of Austria. The claimants, or their deceased relatives, had contracted the virus in the winter holiday resort. The Ischgl hotspot is considered one of the hubs from which Covid-19 was carried to many countries at the time. Sick visitors to the ski resort have tried many times in recent years to hold Austria accountable. So far, at least 80 lawsuits have been filed by sick vacationers and surviving dependents, which have often been dismissed by the Vienna Regional Court.
At the end of July, however, the responsible court of appeal overturned such decisions by the district court in 25 cases, as it was convinced that the federal state of Tyrol had concealed known cases of infection among holidaymakers in Ischgl in a March 2020 notification. Thus, the risk of infection with Corona was deliberately misinformed. Corresponding legal disputes must now be decided anew by the Vienna District Court, taking this assessment into account. Anyone who was familiar with the communication in question and trusted the situation described in it can, under certain circumstances, expect a new outcome to the lawsuit.
Ischgl bang: Germans are not only suing Austria, but also representatives of the tourism industry
At the same time, a woman from Germany, who fell seriously ill with Corona during a vacation in Ischgl in March 2020, is now launching a legal bang with regard to the processes for compensation. In addition to the Republic of Austria, which is accused of failing to deal with Covid-19 and contributing to the spread in Europe, the woman is also directing her complaint against a hotelier – this approach of demanding compensation from a non-governmental body is unique in the Ischgl falls.
In the legal dispute, which will be heard on Friday (September 9th) before the Vienna Regional Court for Civil Law, the hotel operator has to defend itself against the accusation that the holidaymaker was wrongly informed about the risk of infection with Covid-19 at the time. According to the consumer protection association, which supports this and other lawsuits, the woman asked the hotel before her arrival whether there was a problem with Covid-19 in Ischgl and received an incorrect answer. Now she is demanding a sum of 42,000 euros from the company.
