The Congress of Deputies approved the trials this Thursday express for the squatters and speeds up housing recovery. The PNV, with the support of the PP, Junts, ERC, UPN, Canarian Coalition and, by mistake, Bildu, managed to carry out its amendment to the Justice Efficiency Bill to change the Criminal Procedure Law and include cases of occupation of homes in the abbreviated procedure.
Specifically, the approved amendment modifies article 795 of the law, which regulates abbreviated procedures, to include burglary and home invasion among them.
Abbreviated procedures occur when the crimes are less serious, that is, they carry prison sentences of less than five years, and the offender is caught during their execution. The crimes of theft, robbery, traffic safety, among others, are also included in the quick trials.
The deadlines for the abbreviated procedure
Abbreviated procedures are characterized because, once the offender is arrested, the judge summons him to appear within a maximum period of 72 hours while the judicial police prepares the necessary reports and documentation at this time.
These data are sent to the judge, who will evaluate whether or not to request urgent proceedings. Once the proceedings are completed, the judge will hear the parties and the Prosecutor’s Office. If they request an oral trial, they must present a document of accusation to the judge and the accused will have five days to present your defense brief. Once delivered, the judge will place the trial date within a maximum period of 15 days. Once this is held, a sentence must be handed down within a period of three days.
Bildu’s mistake
Bildu’s spokesperson in Congress, Mertxe Aizpurua, acknowledged her mistake this Friday and promised to find ways to correct the effects of the amendment. However, the bill, once approved this Thursday by Congress, now goes to the Senate, where the PP has a majority, making it difficult for it to join political forces to overturn the amendment.
